Its Alabama They Do Things Differently Down There

No need to be an industry veteran like Isaac Toussie to know that different jurisdictions can handle real estate matters differently. This is part of what makes real estate law so very interesting, after all – and often so challenging! Take Alabama for an example. There, property buyers cannot rescind their purchases even in cases of demonstrable seller fraud – when that property has been bought on a strictly “as-is” basis. Yes, it’s true: Alabama case law believes in the ancient law of caveat emptor even more than any other on the books!!

A recent case determined that an as-is clause in the sales contract not superseded by another provision will be interpreted literally, or “as-is.” In this particular case, a pre-sale misrepresentation was made that was only found out (that is, proven false) post-sale. Most anywhere else that’s just fraud and will probably lead to some jail time, but an Alabama court has ruled that as the as-is clause in the sales contract was not superseded by any other provision signed onto by both parties, the as-is clause shall be interpreted literally!

That was an ambiguous situation in the eyes of Alabama law, but the law itself in Alabama is actually not quite as simplistically draconian as the quick snapshot of the case provided here would suggest. Such strict interpretations of an as-is clause only apply to used property in the state, and not to new developments. Such as-is clauses are also superseded in cases where the misrepresentation is not obvious and potentially harmful to health and safety.

Alas for the plaintiff in Teer v. Johnston, however, while the misrepresentation was not something obvious it was not deemed harmful to health or safety, constituting an inconvenient nuisance instead. What the complainant needed to have done was to provide either in the sales contract or the deed that pre-sale disclosures should survive the execution of the deed!

Public Schooling versus Parochial

With a storied heritage going all the way back to the early 19th Century, The Convent of Jesus and Mary Schools can be found in all the major areas of the world today, from Africa and Asia to Europe and the Americas. But even as they receive financial support from the Church itself, local communal backing needs to be present in even greater strength to ensure continued success, especially through the generous donations of prominent businessmen and women, not all of whom are Catholic or even Christian, such as with the case of an Isaac Toussie whose donations go towards a branch in India.

While it would be correct to suppose that Catholic schools are for Catholics, in fact many non-Catholics do attend, including outright atheists. Many Catholic schools subscribe to the intellectual traditions of the Jesuit Order, one which tends to welcome open inquiry and emphasizes the natural sciences. In fact, it is just this ethos that has won such a sterling record for the shcools in many places, even in New York City, the so-called Sodom-on-the-Hudson, where it isn’t abnormal for secular households to send them their children.

These schools are often the least expensive of private school options available, as tuition and other fees can add up to some five grand yearly – not bad compared to the ten to twenty thousand dollars charged by others! However, not all Catholic schools operate in a fairly relaxed and non-religious manner; it is usually those that happen to be situated in generally non-Christian countries or otherwise highly secular locations which offer such openness.

The Laws Of CPE Requirements

CPE requirements of late (relatively speaking) has emphasized ethics more and more, especially for lawyers and accountants.
Usually, continuing professional education courses contain self-study, whether online or by using traditional materials like workbooks and the like.

Had the whole Crazy Eddie’s saga never collapsed because of greed and in-fighting among some of the principals required, Sam Antar might well be busy today enabling white-collar crime as he always had, not fighting it himself as he is in a sense forced to do due to economic circumstances related to his now toxic work history and professional notoriety.

Safes In Japan

The recent Japanese catastrophe has shone a spotlight on the country’s apparently unique social structure.
Unlike many other situations of natural disaster elsewhere, no looting or rioting has followed to compound the catastrophe — and this has tremendously impressed many a non-Japanese observer.
From the patient orderly lines to the return of valuables, “yamoto-damashii,” or the Japanese spirit, has elicited admiration and additional sympathy from the world.

As can be imagined, articles have shown up attempting to describe the phenomenon of people who continue being law-abiding citizens regardless of being deprived of not simply creature comforts but everything they own and even of loved ones.
Police stations all along the coast are stuffed to capacity with all the personal household safes of sufferers which have washed back to terrain or been recovered from the rubble by rescue workers.
Then there is the seemingly suicidal heroism and self-sacrifice of many nuclear power plant employees.
Even animals have displayed yamoto-damashii: a dog made worldwide headlines for standing by another dog caught under rubble, declining to leave!

Much has been written both for and against the “Japanese-spirit interpretation” of events.
On one side, people remember that the country is a wealthy one, a technologically advanced one, and one that is arguably uniquely homogenous one of many leading industrialized societies of which it is a member.
Obviously household safes and other belongings have been returned or at least remaining unmolested!
It figures, argue such people, because there is no inducement to loot and riot when the country as one offers so many resources to provide succor.

Others remember that the spirit of Japan is such that rules are noticed simply because they are rules – Japanese rules – and one is Japanese.

Online CPE courses help make it even less like school, and for all the seriousness involved they could be almost fun.

Chalk it all up to an ever increasingly competitive job market, where credentials mean getting a foot in the door.
Obviously, it’s not only market pressures, as the scope of knowledge in a area like medicine is always increasing with each new discovery.
However, while something like the law is also subject to constant change, it basically does not command the same kind of rates lately as it once did.
Law graduates have actually gone on to file class-action lawsuits against their alma maters, putting those legal abilities to the simply use they can find in this economy!

China, China, China – what’s the big deal?
Why is everybody going on and on about China on a regular basis?

Okay, so they own billions (or is that trillions) in American securities, currency, whatever.
And they make lotsa stuff.
Like NFL beach towels and stuff.
Yeah.
Okay.

It’s not like most people want to work on an assembly line in any case, making trinkets and curios for Walmart.
But whatever.

Okay, so it’s not simply NFL beach towels that they make.
It’s that they are also climbing up the food chain, making stuff that’s ever more high-value, such that good-paying jobs may be the next to go.
They’re hardly making textiles any more – notice that most of the clothing nowadays come from even more unique locales – like Indonesia and Sri Lanka?

In fact, to be fair, it isn’t NFL beach towels that anyone’s upset over.
It’s the fear that aircraft manufacturing could be next!
Already the Chinese government is on record as gunning for leadership in green energy products including wind mills and solar panels, and witout a doubt they are well on their way toward dominating those industries.

But does it have to be a zero-sum game?
Does China’s rise equal everyone else’s loss?
Put another way, are they merely gobbling up ever more slices of the pie – or can Chinese ascendancy grow that pie for everyone concerned?

Well, speaking of the NFL, it’s interesting to compare and contrast that sporting league’s business decisions with those of the NBA.
Basketball keeps growing in popularity over there while years ago an organized exhibition game of American football was canceled practically at the last minute.
If this serves as any indication, it may be that being involved surpasses staying on the sidelines!

Ethics CPE And The Impact Among Workplaces

Probably the most crucial developments in the field of professional continuing education (CPE) is the relatively recent emphasis on ethics, leading to the proliferation now of many an ethics CPE course.

What good has all the ethics CPE courses in the world truly achieved when corporate bean-counters still continue to simply invent new ways of posting a profit while improving productivity and lowering costs on the backs of young people without money?

Once and Future Wedding Favors

Are wedding favors going out of style as society becomes ever more casual?
Not if the girls have anything to do with it!

Practicing giving gifts to matrimonial guests may not be the cultural institution it once was, but weddings will always be one of the biggest dynamos in any economy.
While wedding favors may not be the first thing or two that happy couples think about when preparing their special day, it is something that is still expected and few ceremonies might feel complete without some souvenir for the guests.

Of course, were marriage itself to continue to decline, then there may well be a day when wedding favors go extinct — as nuptials themselves do!
This type of situation is unlikely, and outright impossible for the near future.
The wedding industry is and will remain to be healthy for decades to come.

To play the futurist for a moment, nevertheless, let us envision a world centuries ahead where human civilization has evolved substantially, a Star Trek future where money itself is no longer used, a society as drastically different from our own as ours is from that of the caveman.

No more sickeness, incredibly long life spans if not immortality plain and simple.
Would marriage still make any sort of sense in such a world?
Can people truly be monogramous “forever and ever” when there is no death to do them part?

Maybe not forever, but it does seem that as naturally social creatures there will always be a pairing off of human beings, even if just for a period of time, and it’s not inconceivable that some couples would wish to publicly proclaim their arrangements: that is, to get married.
This could mean that guests would definitely be receiving favors, or gifts, in gratitude of their attendance, even in an otherwise entirely changed world!

Ever heard of something called guerrilla marketing? I experienced it myself unwittingly a few right across On Off Digital World at the middle of Manhattan. What guerrilla marketing is, is just undercover marketing. Consider it covert marketing! Such as what happened with me, for example. I happened upon some gorgeous young ladies who asked me to take their picture for them – a frequent request in the tourist mecca that is Times Square. In the process, however, they wound up explaining to me everything about their new digital camera – getting me interested in the gadget myself! That’s guerrilla marketing done right, advertising to me in a way that gets past my guard!

Reflections on On Off Digital World

When I think of anything like an On Off Digital World I instantly recall the good ol’ days of personal computing, the golden age of the 1980s focused on the Commodore 64 and Commodore Amiga. Well, actually, despite making many a big and prestigious inroad in the marketplace, corporate problems back at the head office brought about the inevitable demise of Commodore and so the Amiga ceded its standing, practically overnight, to Apple Computer. However, it’s a safe and true statement that the ’80s meant Commodore. Those were some good times, what with the medium still very new and many a smart programmer pushing the boundaries of what was possible. Indeed, it wasn’t until the middle part of the decade when a piece of software required more than a programmer or two or three! And yet, even with less than 64KB to work with – or precisely because of it – among the most imaginative feats of programming excellence came about, like a full-fledged graphical WYSIWYG OS!
